By using the Services provided by Best Fax, including our AI-powered support and cover-page writing features ("AI Products"), you agree to comply with this Policy, our Legal Terms, and all applicable laws and regulations.
This Policy applies to:
- (a) uses of our Services (as defined in "Legal Terms")
- (b) our website, software, forms, support tools, and other materials available through the Services ("Content")
- (c) documents, cover pages, and other content you upload to or transmit through the Services by fax ("Customer Fax Content")
- (d) your use of AI Products within our Services
WHO WE ARE
We are Best Fax ("Company," "we," "us," or "our"), located at 1968 Pacific Coast Hwy, #1921, Laguna Beach, CA 92651, United States. We operate the website https://bestfax.com (the "Site"), as well as any other related products and services that refer or link to this Policy (collectively, the "Services").
USE OF THE SERVICES
When you use the Services, you warrant that you will comply with this Policy and with all applicable laws.
You also acknowledge that you may not:
- Use the Services to violate any law, regulation, court order, or binding legal obligation.
- Send unsolicited fax advertisements or other fax communications in violation of the Telephone Consumer Protection Act, the Junk Fax Prevention Act, or any similar law. You are responsible for obtaining and maintaining all consent required to fax each recipient and for honoring opt-out requests.
- Use the Services to threaten, harass, intimidate, extort, defraud, or impersonate another person or entity, or to misrepresent the source of a fax.
- Use false pretenses to obtain passwords, authentication credentials, payment information, or other sensitive information from us, a recipient, or another person.
- Create accounts by automated means, share or sell account access, or use another person's account without authorization.
- Make improper use of our support services or knowingly submit false reports of abuse or misconduct.
- Circumvent usage, page, rate, payment, account, or access limits, including by creating or coordinating multiple accounts.
- Interfere with, disrupt, or create an undue burden on the Services or any network or system connected to the Services.
- Probe, scan, or test the vulnerability of the Services, or access data, accounts, or systems not intended for you.
- Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Services, except as expressly permitted by applicable law.
- Attempt to bypass any measures of the Services designed to prevent or restrict access to the Services, or any portion of the Services.
- Harass, annoy, intimidate, or threaten any of our employees or agents engaged in providing any portion of the Services to you.
- Delete the copyright or other proprietary rights notice from any Content.
- Copy or adapt the Services' software or source code.
- Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other malicious material, or any material that interferes with any party's uninterrupted use and enjoyment of the Services or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Services.
- Upload or transmit (or attempt to upload or to transmit) any material that acts as a passive or active information collection or transmission mechanism, such as spyware, web bugs, or similar devices.
- Use bots, scripts, scrapers, or other automated tools to access or operate the Services without our written permission, except for ordinary search-engine indexing.
Subscriptions
If you subscribe to our Services, you understand, acknowledge, and agree that you may not, except if expressly permitted:
- Share, sell, or resell subscription access except through team-user features we expressly provide.
- Use multiple subscriptions or accounts to circumvent sending, page, rate, payment, or other service limits.
- Use a subscription to intercept, access, alter, or disclose fax data not intended for you.
- Use a subscription in a way that damages or disrupts another person's hardware, software, account, or information.
- Use a subscription to send unsolicited fax advertisements or otherwise evade this Policy's limits.
AI Products
When you use the AI Products provided by Best Fax, you warrant that you will not:
- Use AI-generated cover-page text or support responses to facilitate unlawful faxing, fraud, impersonation, harassment, discrimination, or infringement of another person's rights.
- Submit content to an AI Product that you do not have the right or lawful authority to use, including confidential or sensitive information belonging to another person.
- Attempt to manipulate an AI Product to reveal system instructions, credentials, another user's information, or other data not intended for you.
- Rely on AI-generated text as legal, medical, financial, or other professional advice without review by a qualified professional.
- Use an AI Product in violation of an applicable AI Service Provider's terms or policies.
ARTIFICIAL INTELLIGENCE
Our AI Products currently include support assistance and tools that help users draft or improve fax cover-page text. AI output may be inaccurate or incomplete, and you are responsible for reviewing it before using or transmitting it.
This Policy applies whenever you interact with an AI Product through the Services. AI Products do not change your responsibility for your Customer Fax Content, its recipients, or compliance with applicable law.
Enforcement
Any misuse of our AI Products or failure to adhere to the standards outlined in this Policy will result in appropriate actions to ensure the integrity of our platform and the protection of our users. The specific consequences for misuse of AI may vary depending on the nature and severity of the violation and the user's history with our Services.
Violations may include, but are not limited to:
- Engaging the AI Products in ways that violate user privacy, manipulate data, disregard ethical guidelines, or are against AI Service Providers' terms of use.
- Using AI-generated material to mislead, discriminate against, threaten, or harm a person or group.
- Submitting data without the rights, consent, or lawful authority required to process it.
- Using AI in a way that compromises the privacy and security of our systems, data, or users.
Depending on the violation, Best Fax may take one or more of the following actions:
- Warnings: The responsible party may receive a formal warning and be required to cease violating practices.
- Temporary Suspension: In cases of repeated or more severe violations, the responsible individual's access to AI Products or certain features of our platform may be temporarily suspended while the issue is investigated.
- Termination of Access: Serious violations, particularly those that result in harm to users or breach privacy or other regulations, may lead to the permanent termination of access to our AI Products and Services.
- Legal Action: In cases where the misuse of AI leads to significant harm, data breaches, or legal violations, we may pursue legal action against the party responsible. This could include reporting the incident to law enforcement or regulatory bodies.
Commitment to Responsible AI
We may add safeguards, restrict a feature, or correct identified problems when misuse of an AI Product causes or risks harm.
We will review this Policy as our AI Products, applicable laws, and provider requirements change.
CUSTOMER FAX CONTENT
In this Policy, "Customer Fax Content" means the documents, cover pages, and other content you upload to or transmit through the Services by fax. Customer Fax Content is treated as private communication between you and your recipients; it is not published or made available to other users by us.
You warrant that:
- you are the creator and owner of, or have the necessary licenses, rights, consents, releases, and permissions to transmit, your Customer Fax Content;
- your Customer Fax Content and its transmission comply with applicable laws; and
- the transmission of your Customer Fax Content does not and will not infringe the rights of any third party, including intellectual property, privacy, and publicity rights.
You also agree that you will not upload or transmit any Customer Fax Content that:
- is in breach of applicable laws, regulations, court orders, contractual obligations, this Policy, our Legal Terms, or a legal duty, or that promotes or facilitates fraud or illegal activities;
- constitutes an unsolicited fax advertisement in violation of the Telephone Consumer Protection Act, the Junk Fax Prevention Act, or any similar law;
- is intended to threaten, harass, intimidate, extort, or defraud any recipient;
- contains malware, spyware, malicious code, or instructions intended to compromise a recipient's device, account, or network;
- infringes or misappropriates another person's copyright, trademark, trade secret, privacy, publicity, or other rights;
- includes child sexual abuse material or otherwise violates any applicable law intended to protect minors; or
- contains another person's protected health, financial, or other sensitive personal information transmitted without lawful authority to do so, or contains any other category of illegal content.
REPORTING A BREACH OF THIS POLICY
We may, but are under no obligation to, review or moderate content transmitted through the Services, and we expressly exclude our liability for any loss or damage resulting from a user's breach of this Policy.
If you believe that any Service, Content, or Customer Fax Content breaches this Policy, infringes third-party intellectual property rights, or otherwise presents an abuse concern, email support@bestfax.com and explain the concern.
- Identify the fax, feature, or material involved without sending us unnecessary sensitive information.
- Describe why you believe it violates this Policy or another person's rights.
- For an AI Product concern, include the context, the nature of the concern, and any relevant screenshots or documentation.
We will determine, acting reasonably, whether a Service, Content, or Customer Fax Content breaches this Policy.
CONSEQUENCES OF BREACHING THIS POLICY
The consequences for violating this Policy will vary depending on the severity of the breach and the user's history with the Services.
We may give you a warning or remove infringing content. If your breach is serious or you continue to breach our Legal Terms or this Policy, we may suspend or terminate your access to the Services and, if applicable, disable your account. We may also notify law enforcement or begin legal proceedings when we believe there is a genuine risk to an individual or a threat to public safety.
To the extent permitted by law, we exclude liability for actions we take in response to a breach of this Policy.
DISCLAIMER
Best Fax is under no obligation to monitor users' activities, and we disclaim any responsibility for any user's misuse of the Services. Best Fax has no responsibility for any user or any Content or Customer Fax Content created, maintained, stored, transmitted, or accessible on or through the Services, and is not obligated to monitor or exercise any editorial control over such material. If Best Fax becomes aware that any such Content or Customer Fax Content violates this Policy, Best Fax may, in addition to removing such Content or Customer Fax Content and blocking your account, report such breach to the police or appropriate regulatory authority. Unless otherwise stated in this Policy, Best Fax disclaims any obligation to any person who has not entered into an agreement with Best Fax for the use of the Services.
